Anguillan Hotelier Deported


Kirk McAllister Hughes, the Anguillan hotelier who was fined $56,000 and spent months at Her Majesty’s Prison after being convicted of Immigration and financial-related crimes in the Territory was ordered deported from the Territory by the Governor.

In an Order dated 22 February, Deputy Governor David Archer who was acting for His Excellency Governor Augustus Jaspert ordered the deportation of Kirk McAllister Hughes who was named as an accomplice in smuggling six Hispanic migrants in the territory between August and September of 2018.

It was stated that Hughes who is an overseas based hotelier got entangled with the law when he was named by illegal migrants who said that he was their contact and “gang leader” when they illegally entered the BVI between August and September 2018.

During his court appearance it was revealed that when police apprehended Hughes they found a ‘large sum’ of cash in his vehicle, a sum of cash at a residence he had rented in Hannah’s Estate, plus other cash and a number of mobile phones were found at another property that was rented by Hughes in Soldier’s Hill on Tortola. The court heard that the monies approximately totaled $45,831.

Hughes later pleaded guilty to overstaying, failing to declare monies to Customs, and being in possession of proceeds of criminal conduct.

He was fined $55,000 for failing to declare monies to Customs; plus slapped with a five-month prison sentence, as well as a $1,000 fine for overstaying in the territory. Additionally, Hughes was also sentenced to eight months imprisonment for the $45,831 he stated was the proceeds of crime.

In making the Order the Governor announced that Hughes was required to leave the Territory of the Virgin Islands on or before the expiration of seven days from the date on which a copy of the order is served on him by an immigration officer or a police officer and thereafter to remain out of the Territory.

The Order stated: “Whereas it has come to my knowledge that Kirk McAllister Hughes is a person not deemed to belong to the Territory and that the said Kirk McAllister Hughes has been convicted of the offences of possession of proceeds of criminal conduct and overstaying each of which is punishable with imprisonment of three months or more and, is a person whose presence in the Territory would, in the opinion of the Governor, acting after consultation with the Chief Immigration Officer, be undesirable and not conducive to the public good.”
