Special
Sitting of the Court of Appeal scheduled for Wheatley/Penn
appeal
A special sitting of
the Court of Appeal will be convened in the BVI in September
primarily to hear the appeal brought by L. Allen Wheatley and
Wesley Penn against their convictions and jail sentences.
The Chief Registrar
in St. Lucia has sent a notice of the special sitting commencing
on 29 September. This is outside the two traditional sittings of
the Court of Appeal in the BVI each year in January and June.
According to
information that has reached this newspaper, the Court of Appeal
will also hear the appeal filed by the Commissioner of Police
against the acquittal of Wheatley and Penn on several charges.
The Court of Appeal
will comprise Chief Justice Sir Dennis Byron, Justice of appeals
Albert Redhead and Adrian Saunders. Mr. J.S. Archibald QC, Mr.
Oscar D. Ramjeet and Miss Anthea L. Smith are representing
Wheatley and Penn, while Mr. Terrance Williams, Principal Crown
Counsel and Ms. Shona Griffith, senior Crown Counsel are
appearing for the Commissioner of Police.
